Sir John Birchallasked the Minister of Transport whether he is aware that in a recent case before the Leeds stipendiary magistrate it was proved that the Silkburn Coal Company had allowed a lorry to be driven on the road in such bad condition that a Leeds child was killed while standing on a street refuge; and whether he will take further action to prevent any owners of motor vehicles driving them or compelling their employés to drive them in a dangerous condition?
Captain HudsonI understand that the company have been fined é6o for offences in connection with the use of this lorry. The licensing authority has noted this case and it is for them to consider whether any further action should be taken. The condition of this firm's fleet of vehicles is being kept under observation.
§ Sir J. BirchallIs my hon. and gallant Friend aware that the fine was not for the offence which is the main cause of the question? I am asking whether any steps can be taken in regard to drivers being ordered to take on to the roads lorries which are known to be unfit, an offence to which attention was drawn by the stipendiary magistrate?
Captain HudsonThe licensing authority is an independent authority set up by this House to deal with these matters. If there is another offence which can be proved, it would be for the police to take action.
