I beg to move, in page line 27, at the end, to insert: (d) in the case of Orissa, such provisions with respect to the jurisdiction therein of any court theretofore exercising the jurisdiction of a High Court, either generally or for any particular purpose, in any area to be included in the Province. This and the next Amendment are intended to fill a gap in our proposals with reference to the jurisdiction of certain high courts. They are intended to fill a gap in the arrangements provided for by this Clause for bringing into being before the commencement of Provincial Autonomy of the two new Provinces of Orissa and Sind. The Bihar Government pointed out that the arrangement as it stands partly in virtue of Sub-section (4) would appear to have the result of necessitating that the Patna High Court should assume jurisdiction in all cases pending in the Madras High Court. It was urged with justice that great in justice would result to the public as a result of the arrangement as it stands.
