asked the Home Secretary if he will take steps to ensure that a person against whom a capital charge has been preferred shall not be prejudiced in his defence by lack of means but that in such a case a person may claim for his defence the services of counsel of the same standing as counsel engaged by the Crown to conduct the prosecution?

It is open to the prisoner to apply for legal aid in which event the conduct of his defence will be a matter of arrangement between him- self, his solicitor and counsel. In the event of two counsels being authorised, there is no legal obstacle to one of His Majesty's Counsel, who is willing to appear, being instructed.
