Mr. LONSDALE

asked the Attorney-General for Ireland if he will state whether witnesses who object to take the oath in the new form sanctioned by the Oaths Act, 1909, are entitled to have the oath administered to them either in the old form by kissing the book, or, if they prefer it, in the Scotch form by holding up the right hand, authorised by Section 5 of the Oaths Act, 1888?

In the case mentioned, witnesses are, in my opinion, entitled to be sworn according to the old form, or, if they so desire, with uplifted hand in the Scotch form and manner as authorised by the Act quoted.

Mr. LONSDALE

Is the right hon. Gentleman aware that witnesses have not been allowed to take the oath in the old form, and will he take care that explicit instructions are issued to those who have authority to administer oaths to see that that privilege is allowed to those who desire it.

I was not aware of it. As a matter of fact a circular has been issued containing the direction.
