(1) Where negotiations have been entered into or proposals have been made for the purchase under the Land Purchase Acts of any estate or untenanted land situated in a congested districts county, and the parties have failed to come to an agreement, the Congested Districts Board may, if they think fit, send to the person who appears to them to be the owner a final offer in writing for the purchase of the estate or untenanted land.

(2) The provisions of Part II. of this Act with respect to the particulars to be inserted in a final offer sent by the Estates Commissioners shall apply in the case of a final offer sent by the Congested Districts Board under this section, with the substitution of the Congested Districts Board for the Estates Commissioners, and the provisions of Part II. of this Act with respect to the acceptance of a final offer sent by the Estates Commissioners, shall apply in the case of the acceptance of a final offer sent by the Congested Districts Board, with the substitution of Section seventy-nine of the Act of 1903 for Section seventeen of that Act.

(3) For the purpose of enabling the Congested Districts Board to ascertain the extent and character of the estate or untenanted land, and to estimate the price to be named in the final offer, any inspectors and other persons appointed by the Board may, after notice sent to the person who appears to the Board to be the owner thereof, enter upon the estate or untenanted land and do all such things as may be necessary for the purpose aforesaid.

(4) If the final offer is not accepted in accordance with the foregoing provisions of this section, the Congested Districts Board may, if they think fit, send to the Estates Commissioners a requisition calling upon the Estates Commissioners to take steps to acquire the estate or untenanted land compulsorily in manner provided by Part IV. of this Act.

Mr. BIRRELL moved in Sub-section (1) to leave out the words "the parties have failed to come to an agreement," and to insert the words "no agreement has been arrived at."
