To ask the President of the Board of Education whether, under the rules and orders issued by the Board of Education for the regulation of the appointment of school managers, an undischarged bankrupt is not eligible to act as a foundation manager but is eligible to act as a representative manager.

(Answered by Mr. Runciman.) It is the practice of the Board, in making final orders under Section 11 of the Education Act, 1902, to provide that any person who is adjudicated a bankrupt shall cease to be a foundation manager. The Board have no jurisdiction to make rules and orders as to the qualification of managers appointed by the local education authority or the minor local authority. The Board are not aware of any rule of law which debars those authorities from appointing a bankrupt as a manager.
