HC Deb 09 March 1908 vol 185 cc1113-4
MR. BOLAND (Kerry, S.)

I beg to ask the President of the Board of Trade if he can state whether the Rule Committee has met or has been convened to meet to consider the necessity or propriety of making rules of court for the purposes of The Trade Marks Act, 1905.

I beg also to ask the President of the Board of Trade whether his attention has been called to the fact that rule 121 of The Trade Mark Rules, 1906, is ultra vires, in so far as it purports to regulate proceedings in the High Court of Justice; and what action he proposes to take in the matter.

THE PRESIDENT OF THE BOARD OF TRADE (Mr. LLOYD-GEORGE,) Carnarvon Boroughs

The rule in question was settled by an eminent counsel. It has worked well in practice and without question by the Courts. I have, of course, no objection to bringing before the notice of the Lord Chancellor as head of the Rule Making Committee the points raised in my hon. friend's Questions.
