To ask the Lord Advocate whether the clerk of the Justice of the Peace Court for the county of Bute who advises that court on legal matters upon licensing appeals, is in the habit of attending in the Burgh Licensing Court in support of the application of private individuals for the grant of licences; and, if so, what steps he proposes to take to prevent the repetition of such action.

(Answered by Mr. Thomas Shaw.) The disqualification of the clerk to the Justice of Peace Court does not apply by law so as to prevent him acting as solicitor in the Burgh Court. This seems to be the sound construction of Section 106 of the Licensing (Scotland Act, 1903.
