HC Deb 03 July 1907 vol 177 cc685-6
MR. HAYDEN

To ask the Secretary of State for War whether he will state the names of persons to whom, in the arbitration proceedings over the acquisition of a bog for the Athlone rifle range, compensation was awarded, to whom such compensation has been paid, and the names of the persons who have not received the amount awarded; and whether he will explain the delay in these cases.

(Answered by Mr. Secretary Haldane.) The names of the persons to whom compensation was awarded are stated below. All have been paid save Malachy Lennon, Catherine and Bernard Rafferty, Richard Lennon, Patrick Heslin, Patrick Dignan, and Luke Dignan. In the case of Bernard and Catherine Rafferty it was judicially decided in proceedings before the Master of the Rolls and subsequently the Court of Appeal, and in Malachy Lennon's case before the Master of the Rolls, that those parties were not entitled to be paid any compensation, notwithstanding the awards made in their favour, they not having legal or equitable claim to compensation. The circumstances of the cases of Richard Lennon, Patrick Heslin, and the Dignans were similar to those thus decided and are ruled by them. There has been no delay. The solicitor for the parties was informed by the chief Crown solicitor that the. War Department would not pay them any compensation.
