I beg to ask the Chief Secretary to the Lord-Lieutenant of Ireland whether, in view of the fact that the Congested Districts Board sanctioned a grant of £50 towards constructing a road at Glencar, county Kerry, on condition that it was to be maintained by the county council, and that the Local Government Board has since declared it to be illegal to maintain this road at the expense of the ratepayers, he will state what steps he proposes to take to prevent this road returning to its original state, and the consequent loss of public money.

The auditor disallowed payment of this expenditure on the ground that the road was not a public road within the meaning of the statute. The Local Government Board subsequently remitted the surcharge, on appeal. In order to avoid a similar disallowance hereafter the county council should reconstruct the road so as to bring it within the provisions of Section 55 of the 6 & 7 Will. IV. cap. 116.
