I beg to move, in page 64, line 22, at the end to insert: (e) as to any exceptions and modifications subject to which the provisions of subsections (3) to (5) of this section are to have effect where an interest in any of the servient land is subject to a mortgage, or is subject to a rent charge, chief rent or other rent, payment or incumbrance. Clause 65 provides arrangements for the acquisition of rights over land by river authorities which would lead to the payment of compensation to the owner of an interest in the land, but it is necessary to provide for those cases where the land is subject to a mortgage or a land charge so that the payment to be made should go to someone other than the owner of the land. It is to provide for that that this Amendment is tabled.
