asked the Secretary of State for Foreign Affairs if Her Majesty's Government have yet agreed to the creation of the European Court of Human Rights in view of the fact that the United Kingdom have already ratified the Human Rights Convention.

Mr. Ian Harvey

Yes, Sir. The Human Rights Convention itself provides for the setting up of this Court. By becoming a party to the Convention, Her Majesty's Government have thereby agreed to the creation of the Court.

Mr. Royle

In view of that answer, will the hon. Gentleman say whether the Government will now recognise the jurisdiction of that Court and nominate candidates?

Mr. Harvey

No, Sir. We do not recognise the right of individual petition. That is the reason why we could not accept the jurisdiction, but we shall nominate members of the court.
