I beg to move, in page 9, line 36, to leave out from the first "the," to the end of line 37, and to insert: Minister had been constituted guardian of the monument by a deed not containing any restriction not contained in the order and executed by all the persons who, at the time when the order is made, are able by deed to constitute. The effect of this Amendment is to clarify the Minister's powers under a guardianship order. It is hardly more than a point of drafting. Clause 13, as at present drafted, follows Section 7 (2) of the Ancient Monuments Act, 1913, in that a guardianship order is given the same effect as if the Minister had been made guardian by a deed executed by the owner. Unfortunately, the definition in that Act of "owner" covers a number of separate interests, and it is not clear whether the interests of all possible owners are covered. For that reason we move the Amendment to remove the doubt, so that all the interests in the estate will be fully covered.
