§ 3. Mr. Spearmanasked the Minister of Agriculture on what authority the Forestry Commission gates were locked across public highways and rights of way in the Thornton-le-Dale Forestry Commission area.
§ Sir T. DugdaleI am informed by the Forestry Commission that they have not locked gates across any road which they believe to be a public highway or where there is known to be a general right of way for vehicles. One case is in dispute and the gates have been removed until the status of the road is established.
§ Mr. SpearmanIs my right hon. Friend aware that for over six months the Forestry Commission have been trying to make up their minds whether or not it is legal to block the road? Is he also aware that between July and November a local farmer smashed down the gates on three occasions and reported the matter to the police in the hope of getting a decision? Will he instruct the Forestry Commission that they have no right to consider themselves above the law?
§ Sir T. DugdaleYes, Sir, but the solicitors for the Commission and the parties concerned are at present examining all the available evidence about the status of the road. My hon. Friend will agree that these investigations must take a long time, as much research into legal documents is entailed. If no settlement is reached, the case may have to come before the courts.
