§ 40. Mr. Fletcher-Cookeasked the Under-Secretary of State for Commonwealth Relations with which of the Commonwealth Governments there are no agreements for the enforcing by them of maintenance orders made by United Kingdom courts; whether he is aware of the hardship caused to wives of emigrants whose maintenance orders cannot be enforced; and what steps he proposes to take to try to give them a remedy.
§ Mr. FosterThe only territories of members of the Commonwealth other than the United Kingdom to which the Maintenance Orders (Facilities for Enforcement) Act, 1920, has not been extended by Order in Council are the Canadian Provinces of Quebec and New Brunswick and those parts of India and Pakistan which were not formerly part of British India.
The Act will be extended to New Brunswick in the near future, but the legislature of Quebec has not yet made the provision necessary to enable the Act to be extended to Quebec. The position of the former Indian States is under consideration.
