§ Mr. P. Noel-BakerI beg to move, in page 5, line 25, at the end, to insert:
(2) References in this Act to the retiring of a person include references to the coming to an end of his appointment as an acting judge or an additional judge without his receiving any further appointment as a judge.This Amendment is intended to meet the case of an acting and additional judge. It is necessary because, technically speaking, he is not retired within the meaning of Clause 1 (1, c); he was expecting to be appointed as a judge, but he was not in fact appointed.
