HC Deb 26 November 1948 vol 458 c1572
Mr. P. Noel-Baker

I beg to move, in page 5, line 25, at the end, to insert: (2) References in this Act to the retiring of a person include references to the coming to an end of his appointment as an acting judge or an additional judge without his receiving any further appointment as a judge. This Amendment is intended to meet the case of an acting and additional judge. It is necessary because, technically speaking, he is not retired within the meaning of Clause 1 (1, c); he was expecting to be appointed as a judge, but he was not in fact appointed.

Earl Winterton

I am aware, as is the right hon. Gentleman, that there is a rather difficult and delicate story behind this matter, which I do not want to raise publicly, but I am very glad that the right hon. Gentleman has moved this Amendment.
