asked the Secretary of State for Foreign Affairs whether he is aware that shortly after four men named Westphal, Lotz, Greschner and Przewozny were handed over to the Polish authorities from Fallingbostel Prison, papers authorising their release arrived from Brussels; and what steps have now been taken to recover those men from the Polish Government.

Mr. Mayhew

I am aware that the defence claims to have received from Brussels evidence which would have established the innocence of the first two persons named. This claim is being examined in Germany and I will write to my hon. Friend.

Mr. Stokes

Meanwhile, have these men been sent back or are they still in Germany?

Mr. Mayhew

They have been sent back.

Mr. Stokes

If they ought not to have been sent back, are any steps going to be taken to get them back again?

Mr. Mayhew

I did not say they ought not to have been sent back. I said the defence claims that that is so.

Mr. Stokes

Supposing it is established that the defence claim is correct, will His Majesty's Government take any steps to get them back again?

Mr. Mayhew

I am advised that there would be no legal grounds for recalling them.
