76. Flight-Lieutenant Teeling

asked the Minister of Health if he is aware that considerable hardship is being inflicted On small retail dairymen in Brighton, due to the cancellation of licences by the local health committee, as demanded under Section 22 of the Food and Drugs Act, 1938; whether he is aware that these dairymen cannot carry out the alterations and improvements required because of the war; whether the health committee is compelled enforce the regulations; and whether, in view of the exceptional conditions, due to the war, he will take action in the matter.

My right hon. and learned Friend has no information with regard to the particular instances referred to, but under Section 22 of the Food and Drugs Act, 1938, when a local authority refuse or cancel the registration of a dairyman, an appeal lies to a court of summary jurisdiction and my right hon. and learned Friend has no power to intervene in the matter.
