asked the Secretary of State for Scotland whether he is aware of a recent heather-burning case: in the Court of Session where the judge decided that the regulation, as issued, dealing with this subject conferred no other right on the tenant than the extension of the date of burning; and whether he will carry out his intention by conveying further rights by means of regulation, notwithstanding anything to the contrary in a tenant's lease?

I assume that my hon. Friend refers to the decision recently given by the Sheriff Principal for Inverness, Elgin and Nairn in the Sutherland muirburn case. The position arising from this decision is at present receiving consideration.
