asked the hon. Member for West Swansea, as representing the Charity Commissioners, whether, in view of the national desire that greater facilities should be provided for open-air recreation for young people, he will consider introducing legislation to enable property owners who wish to do so to bequeath their land and houses to trustees for this purpose?

Mr. Lewis Jones

So far as the Charity Commissioners are aware, legislation is not required to enable property owners to devise land to trustees for use for open-air recreation of the public. Under the provisions of the Mortmain and Charitable Uses Act, 1888, land up to 20 acres may be devised for the purposes of a public park and the provisions of the Mortmain and Charitable Uses Act, 1891, enable any quantity of land to be devised for use for public recreation subject to the sanction of the High Court or the Charity Commissioners being obtained.
