38. Mr. Watson

asked the Secretary of State for Scotland whether he will consider introducing legislation to amend Section 36 of the Town Councils (Scotland) Act, 1900, to enable town councils, in the event of vacancies occurring through resignations or deaths of members, to fill such vacancies by holding by-elections?

Mr. Elliot

I am not satisfied, on the information before me, that there is need for amending legislation on this point.

Mr. Watson

Is the right hon. Gentleman aware of the dissatisfaction that exists, particularly in the large burghs, with the present system; and does he not think that these large burghs should enjoy the same privileges as other citizens of Scotland in regard to this matter?

Mr. Elliot

No representations have been received on the matter from the local authorities' association, and the Convention of Burghs have not received any complaints or representations on the matter.
