4. Mr. NEIL MACLEAN

asked the Secretary of State for Scotland whether he is aware that a certain town council in Scotland has refused to grant a certificate from their sanitary inspector as to the condition of a house, on the ground that this can only be done on production by the tenant of a notice from his landlord of an increase of rent under the Rent Restriction Acts; and whether he will take steps to draw the attention of the council to their duty in such a case?

Mr. SKELTON

My right hon. Friend has been in communication with the local authority concerned, who appear to have been under a misapprehension as to the legal position. I am informed that they are now prepared to issue a certificate.

Mr. MACLEAN

Seeing that a decision has been given in the court against one particular tenant, who was refused this certificate, may I ask what action the hon. Member intends to take to get that decision of the court reserved?

Mr. SKELTON

I shall have to consider that point.
