asked the Minister of Transport whether his attention has been drawn to the accident which occurred at Shrewsbury on the 22nd July, 1933, when Harold Norman Harris and Florence Gertrude Fowkes were seriously injured by a motor cyclist, who mounted the pavement and was killed as a result of the accident; whether he is aware that, in the case of the injured persons, no compensation can be obtained through the insurance company owing to the death of the insured person; and whether it is the intention of the Government to introduce legislation in order to deal with cases of hardship and injustice arising in this way?

My attenton had not previously been drawn to this accident. I am aware that as the law stands at present an action brought by an injured person for damages abates on the death of the person against whom the action is brought and would remind my hon. Friend that this question has recently formed the subject of an interim report issued by the Law Revision Committee. The recommendations made in that report are now receiving the careful attention of His Majesty's Government, and I hope that before the Road Traffic Bill now before the House reaches its final stages, it will be found possible to remedy this defect in the law.
