Mr. ISAAC FOOT (by Private Notice)

asked the Secretary of State for the Home Department is he has any information to give in relation to the appeal to the public for money, recently made by the Duke of Atholl; and further, if he is in possession of the figures showing the amount received, the expenses of the scheme, and the moneys distributed amongst charities; and whether the whole fund has yet been distributed; and if he proposes to take any action in the matter either as to the Duke of Atholl's scheme or any similar enterprise in future?

Mr. HANNON

On a point of Order. Is it not a fact that a summons has been served on the Duke of Atholl in this instance, and is not the case sub judice? Is it in order, therefore, to raise this matter before the House?

Mr. FOOT

On that point of Order. My notice was given before there was any announcement as to a summons, and, in consequence of what has happened, I have altered, since that time, the form of my question, so that only matters of public interest are raised in it.

Mr. HANNON

On the point of Order. A summons, I understand, has actually been served, and therefore, the case is before the courts. In these circumstances, I submit to you, Mr. Speaker, that the matter should not have been brought before the House.

Mr. SPEAKER

If the question is sub judice, any answer given will undoubtedly take that fact into consideration.
