HC Deb 11 July 1933 vol 280 cc922-3
30. Mr. PEAT

asked the Minister of Transport whether his attention has been drawn to the considerable number of cases where a person has caused an accident by reason of his negligent driving and has died as a result of the accident, and innocent parties have been precluded from recovering compensation for injuries suffered by them in the accident from the representatives of the deceased or from his insurance company by reason of the operation of the legal principle, actio personalis moritur cum persona; and whether, in order to remedy these hardships, he proposes to introduce legislation to make the insurance company concerned liable notwithstanding the death of the negligent party?

The PARLIAMENTARY SECRETARY to the MINISTRY of TRANSPORT (Lieut.-Colonel Headlam)

I would refer my hon. Friend to the answer which was given on the 15th June in reply to a question on this subject by the hon. Member for East Cardiff (Mr. T. Morris), of which I am sending him a copy.

Mr. PEAT

Could the hon. and gallant Gentleman take some steps to deal with the position of insurance companies, because a, very great deal of injury is done to a number of people in this country?

Lieut.-Colonel HEADLAM

If my hon. Friend will study the answer to the question which was given the other day, he will see that that is not so easy a matter as he seems to think.
