Lords Amendment: In page 11, line 20, at the end, insert: Provided further that in any case where it is proved that a building which is dangerous or injurious to health by reason only of the narrowness or bad arrangement of the streets on any land in a clearance area was acquired by the owner before the nineteenth day of August, nineteen hundred and nineteen, or is occupied by the owner for the purpose of residence or business, the arbitrator shall make to the owner an allowance for the value of the building having regard to the provisions of Part II of the Third Schedule to this Act.

On this Amendment, a question of Privilege arises. It proposes to make a charge by enhancing the amount of compensation.

Mr. JOHNSTON

I beg to move, "That this House doth disagree with the Lords in the said Amendment."

A very few words will suffice to explain why the Government cannot possibly accept this Amendment. It was very adequately discussed in Committee and on Report, and we accepted an Amendment to provide that houses built subsequent to the passage of this Bill would be passed for payment at market value if those houses subsequently were challenged as insanitary solely because of the narrowness of the streets. That provision, we understood, was generally accepted as a fair compromise and it was the utmost length to which the Government could go. May I draw attention to certain words in the Amendment which I am sure will secure unanimous support for the attitude of the Government in resisting it. The words are: or is occupied by the owner for the purpose of residence or business. Supposing a proprietor purchased a property which he knew to be injurious to health as the result of bad arrangement or narrowness of the street, and chose to open a small shop. Although he might have acquired the property at its purely site value, under the terms of this Amendment the local authority would be compelled to give the market value, because he had chosen to open a small shop or to reside on the property. That is the position which I am certain has only to be ex- plained to the House to secure a pretty general endorsement of the attitude of the Government in asking the House to resist this Amendment.

I think that the House, which has been much indebted to the Amendments moved in another place for the improvement of the Bill up to now, should think twice before determining to disagree with the Lords in the Amendment which they ask the House to consider. The general principle of the Amendment is sound enough, that where the landlord has been the possessor of property which has not in any way deteriorated or become injurious to the community but which is required in connection with the widening of roads and streets or required in connection with the clearance of other property, the burden should be placed upon the landlord. I think it is an example of the length to which we have come by argument and discussion upon this Bill. The differences between the two Houses are narrowed down to an extremely fine point. In fact, the danger of any unusual claim for compensation arising under the Amendment is reduced to a minimum. I think that the Under-Secretary of State and the Government have found difficulty, in dealing with the Amendment, of proving any ease of injustice which has actually arisen. If they see that no case of injustice has arisen, let us assume that no case of injustice will arise in the future.

We suggest, according to the Government's own submission, that a great extension of slum clearance will take place and a great impetus will be given to the work of the local authorities, and that it is reasonable to provide against injustice taking place. It does not in any way interfere with the proprietor of insanitary property. The property proposed to be dealt with is good property and not property which is in any way injurious to health. For all these reasons, it is only reasonable to say that a man whose property has been maintained in good condition should be treated in a different way from the man whose property has not been maintained in good condition. The Under-Secretary of State drew attention to the inclusion of the words "is occupied by the owner for the purpose of residence or business." I cannot see; inspite of certain dim and distant hypothetical difficulties, why the Government should object to the Amendment. I still hope that it will be possible for the good sense of the negotiators between the two Houses to come to an agreement on the point. The only possibility of a speculator having bought up properties at site value with the hope of subsequently selling them to the local authority at market value is negatived by words which make it impossible for any claim to be found save where any owner was in possession before 19th August, 1919, which is, I think, the date when the Royal Assent was given to the first of the Scottish Bills.

This Amendment was moved in another place by a Noble Lord who himself had occupied the high position of Secretary of State for Scotland and who—and this I am sure will still more appeal to the right hon. Gentleman—had his origin in the County of Fife. I am now appealing to the sentiments of nationalism of which hon. Gentlemen opposite are such strong supporters. I am only saying that the Noble Lord urged this consideration and especially with reference to the Lang Toon of Kirkcaldy, which is a place where you have these elbows and turns and streets which frequently make it desirable to have clearances. It is quite unreasonable, because of the age-long arrangement of street, that some unfortunate owner should find himself called upon to have his property removed by the community for the purposes and benefit of the community and have to bear the whole weight of this community improvement himself. I therefore say we should think twice before disagreeing with the Lords. I hope the good sense of the two Houses will make it possible to come to arrangements so as not to delay the Bill on what is after all a very minor point.
