42. Mr. KELLY

(for Mr. W. THORNE) asked the Minister of Labour if he is aware that Mr. T. Rogers, 44, Chaucer Road, Forest Gate, E.7, was sent by the local Employment Exchange to work for Mr. C. Chave, 16, Sterry Gardens. Dagenham, Essex, as a boot repairer: that, owing to the insanitary conditions of the workshop, he left his employment at the end of the day and reported to the Exchange; that the senior sanitary inspector for the Borough of Dagenham inspected the premises and reported the workshop as quite unfit to work in; that the local Exchange considered the report from the sanitary inspector, but stopped the man's benefit for a period of six weeks owing to the fact that he left his employment voluntarily without just cause; and what action he intends taking in the matter?

Benefit was disallowed by the Insurance Officer. Mr. Rogers appealed to the Court of Referees, who recommended that benefit should be allowed, and the recommendation has been accepted by the Insurance Officer.

Mr. KELLY

In view of this case, will the Insurance Officer be informed that it is not misconduct when a man leaves a situation which is an unhealthy one of this kind?

Each case, obviously, must be judged on its merits. This particular case has now been allowed by the Court of Referees.
