asked the Secretary for Scotland whether his attention, has been called to the case of Romanes v. Garman, reported in the "Law Times," 1912, vol. 2, page 104, where a judge was summoned as a witness, he being one of the body of directors who had taken part in the commercial transaction; whether he is aware that it was found necessary by the rules of the Court to take the judge's evidence in private; and whether he will introduce legislation this Session to have such evidence taken in public Court in the future, so that all engaged in trading enterprise may be put upon an equal footing in the Courts of the land?

I have made inquiry into the case of Romanes v. Garman. No judge was summoned or examined as a witness either publicly or in private. The latter part of the question, therefore, does not arise.
