asked the Under-Secretary of State for War whether, having regard to Regulation 9 of Section 3 of the Military Service Regulations (Amendment) Order, 1916, R 85, and Regulation 9 of Section 5 of the same Regulations, relating to unattested men, the recruiting officers of the Army are justified in issuing notices calling up unattested men on a date which arrives before the expiration of the two weeks allowed them to make application for the renewal of their certificates of exemption which is given them by the two above-mentioned Regulations of R 85; and, if such notices are wrongly issued, if he will give instructions to the recruiting officers to discontinue the practice the subject of this question?

A man cannot be required to report for military service before the expiry of the period within which he may have a right to apply to a tribunal for renewal of his exemption. Many certificates of exemption are, however, now granted under the Military Service Act, 1916 (Session 2), Section 4 (2), and are not renewable without the leave of the tribunal. I am not aware of any such practice as is suggested in the second part of the question.
