40. Mr. KING

asked the President of the Board of Education whether he is aware of the injury inflicted on some of the poorest and most deserving of the working classes by the unreasonable use made by some local authorities of paragraph 53 (c) of his Code of Regulations for Elementary Schools; and whether he will now cancel that paragraph forthwith, in order to restore to parents of scholars under five years of age the legal right of appeal to the Board of Education against the unreasonable exclusion of their children from school which all other parents possess?

The Board have no evidence which indicates that local education authorities are exercising their discretion in this matter unreasonably, or which would justify the Board in altering this provision in the Code, which has been in force for ten years, in the manner suggested.
