HC Deb 21 February 1916 vol 80 cc420-1
76. Mr. THOMAS

asked the Under-Secretary for War whether he is aware that included among those who come under the Military Service Act, 1916, are men suffering from the effects of an accident and in receipt of compensation; and whether, in the event of these men being called up for service and breaking down during training as a result of the development of their previous injury, the Government or their former employers would be liable for compensation?

Mr. TENNANT

The liability of the man's former employer is a legal question which I am afraid I cannot attempt to determine in reply to a hypothetical question. The claim to any Army pension would depend on whether the man had suffered an injury in the performance of military duty, and this would be determined in the light of the circumstances of each particular case.
