asked the Secretary to the Treasury whether he will obtain the opinion of the Law Officers as to the legality of any deduction by an employer under the National Insurance Act from wages paid by him under a contract of service for a fixed wage?

Section 3 of the Third Schedule of the National Insurance Act authorises the employer to deduct from wages paid him, the workman's part of the contribution payable under Part I. of the National Insurance Act, notwithstanding the provisions of any contract to the contrary. The effect of this Section, in the opinion of our legal advisers is perfectly clear, and I do not consider that any reference to the Law Officers is necessary.
