§ 44. Captain CLIVEasked whether, if a man is insured under Part II. of the National Insurance Act and it afterwards transpires that he was not so insurable, the money that has been paid by him and his employer will be recoverable, and, if so, from whom?
Mr. ROBERTSONWhen contributions have been paid under an erroneous belief that a workman was a workman in an insured trade, the Board of Trade will make a refund in full to the employer and the workman respectively, on proper application being made, subject, however, in the case of the workman, to the deduction of any unemployment benefit that may have been paid to him in respect of those contributions. The point is covered by paragraph 31 of the Unemployment Insurance Regulations, 1912, of which I am sending the hon. Member a copy.
