asked whether District Inspector Fleming, Thomastown, county Kilkenny, recently caused a constable in his district to be illegally and improperly arrested on a charge of felony, the result of which was that the constable was lodged in Waterford Gaol; whether the resident magistrate who heard the charged refused informations; and what action was taken in the matter by the Inspector-General?

On 9th February last District Inspector Fleming arrested a constable on a charge of rape. He brought him at once before a magistrate, who remanded him for eight days, and he was lodged in Waterford Gaol. The charge was investigated before a resident magistrate on 15th February, when informations were refused. The constable subsequently asked permission to take an action against the district inspector for false arrest and imprisonment, and was informed that he might take whatever legal proceedings he might be advised. He has not yet acted on this permission, and while the matter is pending the Inspector-General has taken no further action.
