I beg to ask the Secretary for Scotland whether his attention has been called to the judgment of the House of Lords in the case of Montgomerie and Company, Limited, Bermaline Mills, Haddington v. the Burgh of Haddington; and whether, in view of the present uncertain state of the law regarding this question, he will consider the advisability of introducing legislation.

I do not think that the state of the law in regard to the questions at issue in this case can be described as uncertain in view of the recent decision of the House of Lords, approving as it did, a unanimous decision of the Court of Session. It does not seem to mo, therefore, that there is any-call for legislation on the ground stated by my hon. friend.
