To ask the Secretary of State for the Home Department whether his attention has been called to the practice of certain magistrates of adjudicating in cases where, as guardians of the poor, they are prosecutors;and whether he will cause a circular to be issued intimating the undesirability of the practice.

(Answered by Mr. Secretary Gladstone.) I have no information to show that any circular on this subject is called for. I may point out that there is nothing to prevent magistrates who are guardians adjudicating in such cases, provided that they were not present at the meeting of guardians at which the resolution to prosecute was passed.
