HC Deb 24 April 1907 vol 173 cc52-3
MR. SHEEHY (Meath, S.)

I beg to ask the Chief Secretary to the Lord-Lieutenant of Ireland whether he is aware that the estates of Thomas Francis Fay, at Clonmowley, Longwood, county Meath, and in the county of Cavan, have been in the Court of Bankruptcy for the past twenty years; whether the 40th Section of the Land Act of 1896 applies to these estates; and, if so, will he explain why no steps have been taken to apply this section to them; and if he will give directions to have the matter brought before the Courts without farther delay.

MR. BIRRELL

I am informed that the estate in question has been in the Court of Bankruptcy for the past twenty years. The bankrupt has a life interest only in the estate. The assignees receive the rents and divide the proceeds among the creditors. No proceedings for the sale of the estate have been instituted in the Land Judge's Court, and therefore the 40th Section of the Land Act of 1896 does not apply to the case.
