MR. GODDARD CLARKE (Camberwell, Peckham)

I beg to ask the Secretary of State for the Home Department whether he is aware that Mr. Edmund J. Green, of 101, Peckham Park Road, S.E., was refused by the magistrate at Lambeth police court a certificate of exemption from vaccination, although he stated that he conscientiously believed that vaccination would be detrimental to the health of his child; and will be take steps to bring before the magistrates the views of the Lord Chief Justice as to their duties under the conscience clause of The Vaccination Act, 1898, pending such alteration of the law as the Government have in contemplation.

I have no information of the facts of this particular case; but the law requires an applicant to satisfy the magistrate that he conscientiously believes that vaccination will be injurious to the child in question, and therefore I cannot take any action in the matter. The magistrates are well aware of the views of the Lord Chief Justice on the subject.
