I beg to ask the Secretary of State for War whether paragraph 438 of the King's Regulations for the Army, under which an officer has no right to demand a Court-martial upon himself, precludes the officers who have been relieved from duty in consequence of the Report of the Committee on Sales and Refunds to Contractors in South Africa from making such application; and whether it was intended that such officers should be deprived of corps pay by reason of having been so relieved from duty, although no charge had been made against them and the Public Prosecutor-had reported there were no grounds for making any.

Paragraph 438 of the King's Regulations applies to all officers alike, and the officers mentioned in the Question have no right to demand a Court-martial. These officers are at present receiving their full pay.
