To ask the President of the Board of Trade whether he is aware that, prior to the opening of the Buncrana to Carndonagh Railway, arbitrators were appointed by his Department, in pursuance of Section 6 of The Tramways (Ireland) Act, 1883; and whether, seeing that the Section only contemplated the appointment of arbitrators after the opening of the railway for traffic, he will explain why the Board of Trade appointed arbitrators prior to the opening of the line for traffic.

(Answered by Mr. Gerald Balfour.) The Section in question appears to contemplate the appointment of arbitrators at any time during the continuance of the guarantee, and before an appointment was made in the present instance an assurance was received from the Railway Company that the whole of the guaranteed capital had been raised.
