MR. HEY WOOD JOHNSTONE (Sussex, Horsham)

I beg to ask the President of the Local Government Board, if at the date of the transfer to a district council of the powers, duties, and liabilities of a highway authority, particular highways, or parts of highways, within the area of the highway authority are out of repair, and the district council determine that the highways, within that area shall be placed in proper repair before the expenses of repairing the same become a charge upon the district, and accordingly proceed under Section 82 of The Local Government Act, 1894, to put them in repair, who is responsible for maintaining and keeping in repair other highways within the area which are in proper repair at the date of the transfer, between such date and the date when under such resolution of the district council the highway expenses of the area become a charge upon the district?

I have no authority to decide questions of this kind, but I apprehend that under the circumstances stated in the question it would devolve on the Rural District Council to maintain and repair the highways referred to.
