I beg to ask the Secretary of State for the Home Department whether, in the case of the boy James Handley, aged 15, now under sentence of death at Wicklow as "a party to" a murder, he will act upon the precedent for commutation, on the ground of youth, afforded by the case of Constance Kent, formerly convicted of murder and now at liberty?

MR. MATTHEWS

The exercise of the prerogative of mercy in Ireland rests with the Lord Lieutenant, to whom any memorial on behalf of a condemned person should be addressed.

Perhaps the Chief Secretary will take it into his consideration?

The ordinary and proper course is to memorialise the Lord Lieutenant.

Will the right hon. Gentleman tell me, is the prerogative of mercy presumably exercised by the Lord Lieutenant or the Minister?
