LYELL (Orkney and Shetland)I beg to ask the Lord Advocate whether the management and maintenance of the police in Orkney is vested in the Standing Joint Committee, although the county is exempted from the Police Act of 1857; and, if not, who is responsible for the control and maintenance of the police?
§ *MR. J. P. B. ROBERTSONBy Section 76 of the Police Act of 1857, that Statute does not extend to Orkney and Shetland, unless Her Majesty in Council shall so direct. Those counties remain outside the Act of 1857, and the relative Police Clauses of the Local Government (Scotland) Act, 1889, an existing police force in Orkney being managed under an arrangement between the county and the burgh of Kirkwall entered into in 1858. I may point out, however, that it is in the power of the County Council to apply to Her Majesty in Council under the 76th section of the Act of 1857 for a direction that that Act shall extend to the County of Orkney.
