I beg to ask the Secretary of State for the Home Department whether Mr. Vizitelly, recently imprisoned for the sale of indecent books, has been treated in gaol as a first-class misdemeanant; and, if so, whether this was by direction of the Magistrate who tried the case, or the Home Secretary?

MR. MATTHEWS

Yes, Sir; this prisoner has been treated as a misdemeanant of the first division in accordance with the sentence passed upon him by the Judge at the Central Criminal Court on the 27th of May last.
