asked Her Majesty's Government:

Whether, in the light of Lafferty v. Jessop SLT 846 they will consider introducing into the criminal law of Scotland the equivalent of the discretion vested in the Court of Session in civil cases by the Act of Sederunt [Rules of Court, Consolidation and Amendment] 1965 [SI 1965 No. 321] to "relieve any party from the consequences of any failure" to comply with the provisions of the Acts governing criminal procedure in Scotland.

The Government are considering whether, in the light of the judgment of the High Court inLafferty v Jessop, any amendment to the provisions on criminal procedure in Scotland should be proposed.
