asked the Secretary of State for the Environment what are the current maximum levels of penalty and compensation, available in the case of pollution of natural water courses; and if he has any plans to review these levels

The maximum penalties which can be imposed by Magistrates for water pollution offences under the Control of Pollution Act 1974 part II, are fines not exceeding £2,000 and terms of imprisonment not exceeding three months in respect of each offence. On indictment there is no limit on the fine that may be imposed while the maximum term of imprisonment is two years. In addition, water authorities frequently incur cost in seeking to remedy the effects of pollution incidents and have powers, in these circumstances, to recover the costs from those responsible. Penalties for pollution offences are kept under regular review.
