asked the Secretary of State for Social Services what steps he is taking to ensure that supplement officers receive revised guidance concerning the treatment of childminders' earnings in the light of Commissioner's decision R(FIS) 5/83.

I understand that in this case the Commissioner set aside the decision of the supplementary benefit appeal tribunal on the ground that that decision did not comply with the requirement, in the Supplementary Benefit and Family Income Supplements (Appeals) Rules 1980, to give adequate reasons and find necessary material facts. He directed that the claimant's appeal from the decision of the supplement officer should be referred to a differently constituted tribunal. The re-hearing has been fixed for 31 May 1984.

Until the decision on the re-hearing has been received, and consideration has been given to the question of a further appeal to the Commissioner, I understand that the Chief Adjudication Officer does not propose to revise existing guidance to adjudication officers.
