HL Deb 26 April 1983 vol 441 cc915-6WA
Lord Jenkins of Putney

asked Her Majesty's Government:

Whether they now agree that there is nothing in the 1947 Crown Proceedings Act to prevent legal action by ex-servicemen or their representatives claiming damages for exposure to radiation arising from nuclear-weapon tests.

Lord Glenarthur

The effects of Section 10 of the Crown Proceedings Act, 1947 depend on the grounds for the claim and the circumstances in which it arose. The pursuit of legal action for compensation is a matter for individual claimants and their legal advisers.
