HC Deb 24 February 1982 vol 18 c400W
34. Mr. Canavan

asked the Solicitor-General for Scotland what criteria are used by the Crown Office in deciding whether to prosecute for rape.

The Solicitor-General for Scotland

The criteria used in deciding whether to prosecute in a case of rape are the same as for any other crime, namely consideration of each case on its merits having regard to the sufficiency of evidence and all relevant circumstances pertaining to the case.
