§ 35. Mr. Pollockasked the Solicitor-General for Scotland in how many cases since the coming into operation of the Bail etc., (Scotland) Act 1980 proceedings have been taken against offenders who have breached a condition of bail not to commit further crimes while on bail.
The Solicitor-General for ScotlandWhere proceedings are taken against persons who are alleged to have committed an offence while on bail they are charged either with a contravention of section 3(1)(b) of the Bail etc. (Scotland) Act 1980 or with the alleged offence itself. In most cases an accused will be charged with the substantive offence rather than the section 3(1)(b) contravention. Such prosecutions are not separately recorded and therefore figures cannot be provided. However, surveys into the workings of the Act have been carried out by Scottish Office and Crown Office and the results of these should be available shortly.
